Access and use of this portal presuppose your reading, knowledge, and acceptance of these General Terms of Use which, together with the General Sales Conditions of the portal, the Privacy Policy, the Cookie Policy, and the Legal Notices/Disclaimer found in the footer of the home page of the website www.seleneshop.net, define and regulate the use of the website www.seleneshop.net and the services provided to the consumer by Esoteric Market.
Esoteric Market may modify or update these Terms of Use. Such modifications and updates will be notified to users on the home page of the site as soon as they are adopted and will become binding as soon as they are published in this same section. We therefore suggest you access it regularly to check for the publication of the most recent and updated Terms of Use.
If you do not agree, in whole or in part, with these Terms of Use of seleneshop.net and do not intend to accept them, please do not use our website. 1. Terms and Conditions of Use of the Site
The use of the site by each User, whether visitor or registered User, is subject to the terms and conditions of this document even if no purchase is made.
The site’s services are offered exclusively to private Users who make purchases for personal purposes and not related to any commercial or professional activity that may be carried out.
The site’s services are also exclusively intended for persons over 18 years of age; if the User is a minor, they may use the services offered by the portal only by involving a parent or guardian.
2. Site Registration, Personal Registration Profile, and Purchases Without Registration
The User can browse the site and make purchases without the need for registration.
If they wish to register, the User agrees to complete in good faith the registration form found on the site and guarantees that the communicated and registered data are correct and truthful and refer to the person who enters them or, otherwise, that they are entered with the consent of the third party. In particular, the User will be the sole responsible for the communication of incorrect, false, or third-party data that have not expressed their consent, as well as for the improper use of the same. In case of any changes to the provided data, it will be the User’s responsibility to inform Esoteric Market of the updates as soon as possible.
The User is also responsible for the safekeeping and proper use of the credentials that allow access to their registered profile, as well as for any harmful consequences or damage that may arise to Esoteric Market or third parties as a result of improper use, loss, or theft of such credentials.
Without prejudice to legal limits, Esoteric Market cannot be held responsible in any way in case of unauthorized access to Users’ registered profiles by third parties. We therefore ask each User to keep their credentials confidential and to immediately inform Esoteric Market of any suspected unauthorized access to their personal profile or password violation.
3. Product Selection and Order Confirmation
The User who wishes to purchase on the seleneshop.net site can select the products of interest by clicking on the “ADD TO CART” button. Each new product added to their cart will be indicated by the opening of a specific box (window). In the same box, the User will be notified of the following options:
– CART: By clicking this button, a summary screen of the cart contents, including the shipping costs of the chosen item, will be displayed to the User. The User can then complete their purchases by clicking on the PROCEED TO CHECKOUT button or continue browsing to select new products, modify their order, or cancel it;
– GO TO CHECKOUT: By clicking this button, the User will be taken to the purchase request form page, where they must enter their personal identification data to purchase and receive the product. On the same page, the User can choose some optional paid services (e.g., greeting message, special delivery options), will be invited to indicate the chosen payment method, and will be asked to confirm they have read and accepted the General Terms of Use of the seleneshop.net portal and the General Sales Conditions applied by Esoteric Market, to confirm they have read the Privacy Policy on personal data processing and to confirm they have read the Legal Notices/Disclaimer. The User will finally have the possibility to automatically create their own account with the data provided in the form by checking the box next to the phrase “Create an account” and to give their consent to receive the Selene Shop Newsletter. Both choices are merely optional, revocable at any time, and do not affect the order;
– CONTINUE SHOPPING: By clicking this button, the User can continue browsing the site to make further product selections.
During the purchase process, the User can always perform the above-described operations by clicking on the cart icon button located at the top right of each page,
– by clicking directly on the “VIEW CART” button that will appear on the right side of the page after selecting a product, along with the “PAYMENT” button,
– by concluding the product selection and placing the order by clicking the “PAYMENT” button.
4. Payment Methods
Once the selection of the products to be purchased is completed and the “GO TO CHECKOUT” or the “PAYMENT” button is clicked, depending on the navigation page, the User will be taken to the purchase request form page, where they must enter their personal identification data to purchase and receive the product (see point 3 above).
The site offers the following payment methods:
– credit/debit/PostePay card – PayPal – Klarna
If the User chooses bank transfer as the payment method, they must make the transfer for the due amount within 72 hours (three days) from the submission of the purchase request form and send the related payment confirmation to the email address Email info. If the payment is not made within this period, the order will not be accepted and will consequently be canceled.
If the User chooses cash on delivery as the payment method, they must follow the instructions provided on the site, i.e., confirm their phone number and upload the health card/tax code as the recipient’s identification data. In case of anomalies in the shipping data (name, address, etc.), an identity document may also be requested.
We inform the User that, if they have chosen cash on delivery as the payment method but – after the order acceptance and the shipment of goods by the Supplier – the delivery fails i) due to the recipient’s refusal of the package or ii) due to the recipient’s prolonged absence, resulting in the forced return of the package, the shipping costs will be borne by the User.
We also inform the User that if they do not correctly exercise the right of withdrawal according to point 15 of the following General Sales Conditions, the forced return of the package cannot be considered as having been carried out in the exercise of the right of withdrawal; therefore, in addition to the shipping costs, the User will also be responsible for the ancillary costs related to the forced storage, as provided in point 6 of the following General Sales Conditions.
5. Order Acceptance
After the submission of the order request form, a summary window will appear, showing the transaction number and the order receipt. A similar confirmation will also be sent by email. If the chosen payment method is bank transfer or PostePay recharge, the email will also include an invitation to make the payment within 72 hours, under penalty of order cancellation.
The order acceptance and shipping notification will be confirmed by a second email, which will include the order summary data, transaction data, and shipping data of the purchased products.
6. Intellectual and Industrial Property Rights
The contents of seleneshop.net, such as texts, images, photographs, drawings, figures, logos, and any other material, in any format, published on the site, including menus, web pages, graphics, colors, schemes, tools, fonts, and the website design, layout, are protected by copyright and any other intellectual property rights of Esoteric Market and other rights holders. The reproduction, in whole or in part and in any form and for any use, of the seleneshop.net site and its contents, without the prior written authorization of Esoteric Market, is prohibited.
Regarding the use of the seleneshop.net portal, the User is authorized solely to view the site and its contents and to make all those temporary reproductions, devoid of economic significance, that are considered transitory or accessory, an integral and essential part of viewing the site itself and its contents, and all those navigation operations necessary for the legitimate use of the aforementioned portal.
Esoteric Market is the exclusive owner of the SELENE SHOP sign and designs (filed as an application for a European Union trademark), the logos present on the portal, the domain names seleneshop.net, wiccashop.eu, seleneshop.eu, and any other distinctive sign that includes the term “seleneshop” and the aforementioned logos. All other distinctive signs identifying the products sold on the portal and present on the website are registered trademarks owned by their respective owners and are used within the seleneshop.net site for descriptive purposes only, solely to distinguish, describe, and advertise the products for sale.
Esoteric Market and the registered trademark owners have the right to use their respective signs exclusively and to prohibit any unauthorized use.
7. Applicable Law and Dispute Resolution
These General Terms of Use are governed by Italian law and, in particular, by Legislative Decree no. 206 of September 6, 2005 (Consumer Code).
For any dispute relating to the application, execution, and interpretation of this document, the court of the place where the User resides or has elected domicile, or, at the Consumer’s choice, the court of Rome, shall have jurisdiction.
Esoteric Market also informs that the European Commission provides a platform for alternative out-of-court dispute resolution, accessible at http://ec.europa.eu/odr.

Supplier Details
The goods and services subject to these General Terms and Conditions are sold on the e-commerce site seleneshop.net by the individual company Esoteric Market of Giancarlo Bruno, based in Rome, via Amsterdam 132, ZIP code 00144, registered in the Rome Business Register with REA RM – 1630953, Tax Code BRNGCR86H04H501G, VAT number 16036271001, hereinafter referred to as the “Supplier” or “Esoteric Market,” PEC certified email address, owner of the aforementioned site.
1. Definitions
1.1 The term “electronic commerce contract” refers to the contract for goods and services concluded between Esoteric Market and a consumer within a distance selling system organized by the Supplier, which exclusively uses one or more telematic communication techniques for such a contract.
1.2 The term “Purchaser” refers to the consumer as defined in Article 3 of Legislative Decree 206/2005, i.e., an individual who purchases for purposes not related to any commercial or professional activity they may carry out.
1.3 The term “Supplier” refers to the entity indicated in the header that sells the goods or provides the services.
2. Subject of the Contract
2.1 The presentation of goods and services on the website www.seleneshop.net constitutes an invitation to propose, and this electronic commerce contract governs the relationship between the Supplier and the Purchaser for the distance sale of the aforementioned goods and services via telematic tools.
2.2 The goods and services referred to in the preceding point are available on the home page of the mentioned website www.seleneshop.net, listed alphabetically under the “Product Categories” section. The products are depicted and made visible on the site accurately and correspond to their actual characteristics. However, the Supplier cannot guarantee the exact match to reality concerning images and colors as they appear on the customer’s monitor. In case of any discrepancy between the image and the written product description, the description in the product sheet shall prevail.
3. Technical Steps to Conclude the Contract
3.1 The contract between the Supplier and the Purchaser is concluded exclusively via the Internet. The Purchaser, once accessing the site www.seleneshop.net, must follow the procedures indicated on the site itself to formalize the purchase request for the goods and services referred to in Article 2 above.
3.2 Specifically, the purchase contract is concluded upon the completion of the following steps: i) The Purchaser, after selecting the products to be purchased, proceeds according to the provided instructions to complete the electronic order form and transmit it to the Supplier via telematic means, after viewing a web page summarizing the placed order, printable, in which the Purchaser’s details and their order, the product price, shipping costs, and any additional charges, payment methods and terms, the address where the product will be delivered, delivery times, and the existence of the right of withdrawal are reported, and after viewing a link to these General Terms and Conditions of Sale, which the Purchaser will be asked to accept, along with the Terms of Use; ii) The Supplier, upon receiving the order form constituting a purchase request, sends the Purchaser an automatic email confirming receipt, containing the order summary. This email does not constitute acceptance of the purchase request; iii) The contract is considered concluded upon the Supplier sending a second email confirming the acceptance of the order form and indicating all the constitutive elements of the contract formed between the Parties, including the requested Products, the chosen payment method, and the delivery arrangements;
3.3 Once the purchase request is submitted according to the provisions of Article 3.2 above, the Purchaser – if the selected payment method does not provide for simultaneous payment – must make the payment within 72 hours (three days) and, if the chosen method is cash on delivery, must send the requested confirmation SMS according to the instructions provided on the site at the time of the order.
3.4 Failure to comply with the payment deadlines referred to in point 3.3 above will result in the cancellation and nullification of the order.
3.5 Upon receipt of the payment for the goods/services, the Supplier will issue the related fiscal document according to DPR no. 633/1972 where required by law. If the Purchaser wishes to receive an invoice, they must notify the Supplier when completing the order. When completing the order, the Purchaser must provide their tax code or VAT number for this purpose.
3.6 This contract will not be considered finalized and therefore will be void if the conditions listed in the previous points are not met.
3.7 The Supplier reserves the right not to accept order requests from entities other than individual consumers as defined in Article 3 of Legislative Decree 206/2005, incomplete or incorrect order requests, or when there is a report or suspicion of fraudulent or illegal activity, or in case of product unavailability. The Supplier also reserves the right to refuse or cancel a purchase request from a Purchaser who has previously violated these General Terms and Conditions of Sale or the General Terms of Use of the seleneshop.net portal.
3.8 In the cases referred to in Article 3.7, the Supplier will inform the Purchaser via email that the contract is not concluded and that the purchase request has not been accepted, specifying the reasons.
3.9 The Supplier retains a copy of the order form sent by the Purchaser for a period from the contract conclusion to the delivery date of the goods and for ten subsequent years. The Purchaser is authorized to access this written copy at any time by sending an email to the Supplier and attaching their identification document. The registered Purchaser can also access their order through the account dashboard.
4. Order Cancellation
4.1 The Purchaser, within 48 hours of sending the form referred to in point 3.2, may cancel the order, provided that it has not already been prepared for the shipping process. The Purchaser must communicate the cancellation via PEC to the PEC address indicating the order number. If the Purchaser does not have a PEC, within the same 48-hour period, they must send a registered letter with return receipt to Esoteric Market of Giancarlo Bruno, via Amsterdam 132, 00144 Rome, immediately notifying Esoteric Market of the content via email or WhatsApp message to the number indicated on the site. In this circumstance, the order will be canceled without any charge to the Purchaser.
4.2 If the order has already been shipped, the Purchaser can no longer cancel it but must wait for delivery and then return it by exercising the right of withdrawal as provided in point 15 below.
5. Payment Methods and Refunds
5.1 All payments for goods and services purchased by the Purchaser can only be made using the payment methods indicated on the Esoteric Market website. The use of the indicated payment methods does not entail any additional charge to the Purchaser, except in the case of cash on delivery, for which a fee of €5 will be charged.
5.2 If the chosen payment method is via PayPal, the Purchaser will be redirected to the www.paypal.it site where they will make the payment according to the procedure provided and regulated by PayPal itself and the terms and conditions of the contract agreed between the User and PayPal. The data entered on the PayPal site will be processed directly by PayPal and will not be transmitted or shared with the Supplier. If the Purchaser chooses this payment method, the amount due will be debited from the PayPal account upon receipt of the order form constituting the purchase request.
5.3 All payment-related communications take place on a special Supplier line protected by an encryption system. The Supplier guarantees the storage of this information with an additional level of security encryption and in compliance with current regulations on personal data protection.
5.4 Any refunds will be promptly credited to the Purchaser using the same payment method used for the purchase, unless otherwise agreed, and in the case of exercising the right of withdrawal as governed by Article 15 of this contract, no later than 14 days from the day the Supplier becomes aware of the withdrawal. The Supplier may withhold the refund until they have received the returned item or until the Purchaser provides proof of having returned it, whichever situation occurs first.
7. Delivery Times and Methods
7.1 The ordered products will be shipped within 4 working days from the date the Supplier sends the email confirming the acceptance of the order request form and, in any case, within 30 days from the date of conclusion of the contract itself, using the shipping methods chosen by the Purchaser among those indicated on the website.
7.2 In the case of services (e.g., astrological consultation), the provision will take place within 7 days from the date the Supplier sends the email confirming the acceptance of the purchase request form.
7.3 In the case of custom-made products (personalized products, products specifically made for the Purchaser, or temporarily unavailable products with the possibility of restocking), the Supplier will keep the Purchaser constantly updated on the progress of production/availability. As soon as the product becomes available, the Supplier, upon notifying the Purchaser, will arrange for the immediate shipment of the product via the courier selected during the order request phase, with delivery times varying from 24 hours to a maximum of 8 working days.
7.4 If the Supplier is unable to ship within the terms specified in the previous points, they will promptly notify the Purchaser via email or telephone.
7.5 The shipping methods, times, and costs are accurately indicated on the Supplier’s website in the FAQ section.
7.6 The portal owner cannot be held responsible for any courier delays, as the Supplier must only demonstrate that the shipment was made within the specified terms.
7.7 In case of receiving a broken or damaged package, the Purchaser must immediately notify i) directly to the courier, accepting the shipment with the note “acceptance with reservation” or, if this is not possible, ii) by sending an email to the Supplier with photographic evidence of the package or product damage during transport. In such cases, the Purchaser may request a second shipment, which will be carried out at the Supplier’s expense, or a refund of the order.
7.8 If the products are regularly shipped by the Supplier according to point 7.1 but are held due to the Purchaser’s failure to collect the package, resulting in its forced return to Esoteric Market, the costs for the new shipment will be borne by the Purchaser.
8. Prices
8.1 All sale prices displayed and indicated on the website www.seleneshop.net are expressed in Euros and constitute an invitation to propose addressed to users.
8.2 The sale prices referred to in the previous point include VAT and any other applicable taxes. Shipping costs and any additional charges (e.g., customs clearance), if present, are not included in the purchase price but will be calculated and indicated by the Supplier during the order completion procedure before the Purchaser submits the purchase request form and will also be included on the order summary web page.
8.3 The Supplier reserves the right to modify the product prices at any time without notice, provided that the price charged to the Purchaser will be the one indicated on the website at the time of the order, and any subsequent price variations (increases or decreases) after the order form has been submitted will not be considered.
9. Product Availability
9.1 The Supplier ensures the processing and fulfillment of orders without delay through the telematic system used. For this purpose, the real-time availability of the product is indicated in its electronic catalog or its condition of unavailability.
9.2 If, considering the possibility that two Purchasers might simultaneously purchase the same product, an order exceeds the available stock, the Supplier will notify the Purchaser by email or other means (e.g., telephone) whether the product is no longer available for reservation or the waiting time to obtain the chosen product, asking if they wish to confirm the order or not.
9.3 In the event of the situation described in point 9.2:
- if the product is unavailable and the Purchaser has already made the payment, the contract will be considered terminated, and the Supplier will refund the amount paid within a maximum of 20 days according to the methods described in point 5.4;
- if restocking is possible and the Purchaser confirms their interest in purchasing the product, the Supplier will send a confirmation email regarding the product’s availability with the indication of the new delivery time;
- if, despite the possibility of restocking, the Purchaser is no longer interested in the purchase and does not confirm the order, the Supplier will refund the amount paid within a maximum of 20 days according to the methods described in point 5.4.
10. Custom-Made Products
10.1 For custom-made items (personalized products, products specifically made for the Purchaser, or temporarily unavailable products with the possibility of restocking) purchased with cash on delivery payment methods, an immediate deposit of 50% of the product cost will be required, payable through one of the available payment methods indicated on the seleneshop.net website, excluding cash on delivery.
10.2 This amount must be paid within 3 days from the submission of the purchase request form, otherwise the order will be refused or canceled.
10.3 Upon receipt of the payment mentioned in point 10.1, the item will be put into production, and the Supplier will proceed according to point 7.3.
10.4 For custom-made items already purchased with other payment methods, the Supplier will proceed as described in point 7.3.
11. Liability Limitations
11.1 The Supplier assumes no liability for disruptions due to force majeure if they fail to execute the order within the contractually agreed times.
11.2 The Supplier cannot be held responsible to the Purchaser, except in cases of willful misconduct or gross negligence, for disruptions or malfunctions related to the use of the internet beyond their control or that of their sub-suppliers.
11.3 The Supplier will also not be liable for damages, losses, and costs incurred by the Purchaser due to the non-fulfillment of the contract for reasons not attributable to them, with the Purchaser being entitled only to a full refund of the paid price and any additional charges incurred.
11.4 The Supplier assumes no responsibility for the possible fraudulent or unlawful use of credit cards and other payment methods by third parties when paying for the purchased products and services, provided they demonstrate that all possible precautions were taken based on the current state of knowledge and experience and ordinary diligence.
11.5 In no case can the Purchaser be held responsible for delays or issues in payment if they demonstrate that the payment was made according to the methods and times indicated by the Supplier.
12. Liability for Defects, Proof of Damage, and Compensable Damages: Supplier’s Obligations
12.1 The Supplier is liable under Article 114 of the Consumer Code for damage caused by defects in the sold goods if they fail to inform the injured party, within three months of the request, of the identity and domicile of the producer or the person who supplied the goods.
12.2 The injured party’s damage request must be made in writing and must indicate the product that caused the damage, the place and date of purchase. It must also contain an offer to view the product if it still exists.
12.3 The Supplier cannot be held liable for the consequences of a defective product if the defect is due to the conformity of the product with mandatory legal rules or binding provisions or if the state of scientific and technical knowledge, at the time the producer put the product into circulation, did not yet allow the product to be considered defective.
12.4 No compensation will be due if the injured party was aware of the product defect and the danger resulting from it and nevertheless voluntarily exposed themselves to it.
12.5 In any case, the injured party must prove the defect, the damage, and the causal connection between the defect and the damage.
12.6 Damage to property referred to in Article 123 of the Consumer Code will, however, only be compensable to the extent that it exceeds the sum of three hundred and sixty-seven Euros (€ 367).
13. Warranties and Assistance Methods
13.1 The Supplier is liable for any lack of conformity that becomes apparent within two years from the delivery of the goods. To exercise the warranty on the purchased goods, the Purchaser must retain the invoice and the transport document (DDT) that will be sent for each order inside the package, or the copy of the order confirmation received by email.
13.2 For the purposes of this contract, consumer goods are presumed to comply with the contract if, where relevant, the following circumstances coexist: a) they are suitable for the use for which goods of the same type are normally used, b) they comply with the description made by the Supplier and possess the quality of the goods that the Supplier has presented to the Purchaser as a sample or model, c) they have the quality and performance that are normal in goods of the same type and that the consumer can reasonably expect, taking into account the nature of the goods and, where applicable, the public statements on the specific characteristics of the goods made by the Supplier, the producer, or their agent or representative, particularly in advertising or on labeling; d) they are also suitable for any specific use desired by the consumer and which has been brought to the Supplier’s attention at the time of the conclusion of the contract and which the Supplier has accepted by conduct.
13.3 The legal warranty of conformity does not cover product defects resulting from normal wear and tear, abnormal or improper use, accidental events (e.g., falls), or events intentionally caused to the product by the Purchaser or third parties.
13.4 The Purchaser loses all rights if they do not report the lack of conformity to the Supplier within two months from the date on which the defect was discovered. The report is not necessary if the Supplier has recognized the existence of the defect or concealed it.
13.5 In any case, unless proven otherwise, it is presumed that any lack of conformity that becomes apparent within six months from the delivery of the goods already existed on that date, unless this assumption is incompatible with the nature of the goods or the nature of the lack of conformity.
13.6 In the event of a lack of conformity, the Purchaser may request, alternatively and without costs, under the conditions set out below, the repair or replacement of the purchased goods, a reduction in the purchase price, or the termination of this contract, unless the request is objectively impossible to satisfy or is excessively burdensome for the Supplier under Article 130, paragraph 4, of the Consumer Code.
13.7 The request must be submitted in writing, via PEC or registered mail with return receipt, to the addresses of the Supplier indicated in the heading, who will indicate their willingness to process the request, or the reasons preventing them from doing so, within seven working days of receipt. In the same communication, if the Supplier has accepted the Purchaser’s request, they must indicate the shipping or return methods of the goods and the expected time for the return or replacement of the defective goods.
13.8 If repair and replacement are impossible or excessively burdensome, or the Supplier has not provided the repair or replacement of the goods within the period referred to in the previous point, or finally, if the previously carried out replacement or repair has caused significant inconvenience to the Purchaser, the Purchaser may request, at their choice, a suitable reduction in the price or the termination of the contract. In such cases, the Purchaser must submit their request to the Supplier, who will indicate their willingness to process the request, or the reasons preventing them from doing so, within seven working days of receipt.
13.9 In the same communication, if the Supplier has accepted the Purchaser’s request, they must indicate the proposed price reduction or the return methods of the defective goods. In such cases, it is the Purchaser’s responsibility to indicate the methods for the reimbursement of the amounts previously paid to the Supplier.
13.10 As specified in the legal notices on the seleneshop.net website, to which reference is made, the articles and consulting services offered for sale by Esoteric Market.
14. Purchaser’s Obligations
14.1 The Purchaser agrees to pay the price of the purchased goods within the times and methods indicated in the contract.
14.2 The Purchaser agrees, once the online purchase procedure is completed, to print and keep this contract if deemed necessary.
14.3 The information contained in this contract has already been viewed and accepted by the Purchaser, who acknowledges this, as this step is made mandatory before the purchase confirmation.
15. Right of Withdrawal
15.1 The Purchaser has the right to withdraw from the concluded contract, without penalty and without specifying the reason, within 14 calendar days from the day of receipt of the purchased goods. In case of purchasing multiple products delivered at different times, the above term will start from the receipt of the last item subject to the purchase order.
15.2 If the Purchaser decides to exercise the right of withdrawal, they must notify Esoteric Market via PEC to the PEC address or by registered mail with return receipt sent to the following address: Esoteric Market of Giancarlo Bruno, Via Amsterdam 132, 00144 Rome.
15.3 Upon receipt of the communication referred to in point 15.2 above, the Supplier will confirm the withdrawal request and provide the Purchaser with instructions on the courier to use and the transport costs, which will be borne by the Purchaser.
15.4 For the purposes of exercising the right of withdrawal, the sending of the communication referred to in point 15.2 may be validly replaced by the return of the purchased goods to the indicated address, provided within the same 14-day term. The date of delivery to the post office or courier will be binding between the parties.
15.5 The return of the goods by the Purchaser must take place without undue delay and, in any case, within 14 days from the date of communication to the Supplier of the withdrawal. The product must be returned in its original form and packaging, complete with all its parts and accompanied by the delivery note from the courier. If the returned items show damage or signs of wear due to handling not necessary to establish the nature, characteristics, and functioning of the same, the Supplier may withhold from the refund an amount corresponding to their decreased value.
15.6 The only costs owed by the Purchaser for exercising the right of withdrawal under this article are the direct costs of returning the goods to the Supplier, under the terms of point 15.3.
15.7 The Purchaser cannot exercise the right of withdrawal for custom-made or personalized products, rituals, sealed audiovisual products that have been opened by the same, and in all other cases provided for in Article 59 of the Consumer Code.
16. Supplier’s Obligations in Case of Withdrawal
16.1 Upon receipt of the returned product, the Supplier will refund the Purchaser within a maximum of 14 (fourteen) working days from the day they are informed of the consumer’s decision to withdraw, for an amount corresponding to the purchased products. Esoteric Market will make the refund using the same payment method used by the Purchaser for the initial transaction, unless otherwise agreed.
16.2 The Supplier will not refund additional costs if the consumer has expressly chosen a delivery method other than the least expensive type of delivery offered by Esoteric Market.
16.3 Esoteric Market may withhold the refund until they have received the goods returned by the Purchaser or the Purchaser has provided proof of having returned the goods.
17. Termination Causes
17.1 The obligations referred to in point 14 assumed by the Purchaser, as well as the guarantee of successful payment that the Purchaser makes with the means referred to in point 5 and also the exact fulfillment of the obligations assumed by the Supplier in point 7, are essential, so that by express agreement, the non-fulfillment of even one of these obligations, unless caused by force majeure or fortuitous event, will result in the automatic termination of the contract under Article 1456 of the Civil Code, without the need for a judicial ruling.
18. Contract Storage Methods
18.1 The Supplier informs the Purchaser that this contract can be printed or stored on the Purchaser’s own devices.
18.2 Pursuant to Article 12 of Legislative Decree 70/2003, the Supplier informs the Purchaser that each order sent is stored in digital/paper form at the Supplier’s premises, according to confidentiality and security criteria.
19. Communications and Complaints
19.1 Written communications to the Supplier and any complaints will be considered valid only if sent to the following address: Esoteric Market of Giancarlo Bruno, Via Amsterdam 132, 00144 Rome, or sent via email to the following PEC address. The Purchaser indicates in the registration form their residence or domicile, telephone number, and email address to which they wish the Supplier’s communications to be sent.
20. Applicable Law
20.1 These General Sales Conditions are governed by Italian law.
21. Dispute Resolution
21.1 For any dispute relating to the application, execution, and interpretation of this document, the Consumer may activate an online alternative out-of-court dispute resolution procedure using a platform provided by the European Commission, accessible at http://ec.europa.eu/odr.
21.2 Should the Parties intend to refer to the ordinary judicial authority, the competent court is the one of the place where the User resides or has elected domicile, or, at the Consumer’s choice, the court of Rome.
